CONDITIONS OF SALE Listings on this website are not an offer to sell goods, rather, they are advertisements to receive offers. All prices, products, services, and delivery times are subject to change at any time without prior notice. The information contained in this website is subject to change without notice. We are not responsible for typographical, technical, image, pricing, or descriptive errors of products herein.

ORDERS FROM RESELLERS and INSTALLERS Refined Automation maintains a select list of resellers, and installers of its products. We accept orders from our pre-qualified dealers, exporters, wholesalers, or other customers who intend to resell Refined Automation products after verifying their company status, and granting those companies Reseller status, with written approval to resell Refined Automation products. Please inquire at sales@refinedautomation.com if you wish to become a qualified reseller of Refined Automation products. Regardless of customer type, whether end user or otherwise, all orders for more than 3 units of a particular product per address will be subject to review, modification, and acceptance by Refined Automation. As all prices are subject to change, we may have to communicate price changes, additional shipping charges, or availability issues to you after you place your order.

ORDER ACCEPTANCE POLICY Your receipt of an electronic, or other form, of order confirmation does not signify our acceptance of your order, nor does it constitute confirmation of our offer to sell. Refined Automation reserves the right at any time after receipt of your order to accept or decline your order for any reason. Refined Automation reserves the right at any time after receipt of your order, without prior notice to you, to supply less than the quantity you ordered of any item.

In the event a product is listed at an incorrect price, or with incorrect information, due to typographical error, or error in pricing, or product information received from our suppliers, Refined Automation shall have the right to refuse or cancel any orders placed for product listed at the incorrect price. Refined Automation shall have the right to refuse or cancel any such orders whether or not the order has been confirmed and your credit card charged. If your credit card has already been charged for the purchase, and your order is canceled, Refined Automation shall immediately issue a credit to your credit card account in the amount of the charge.

OWNERSHIP All orders are shipped FOB Origin. The risk of loss and title for items on an order pass to the buyer upon delivery of the order by Refined Automation to the carrier.

ORDER PROCESSING TIME Your order is thoroughly reviewed by our Credit Department to ensure that the order is accurate, the payment method is valid, and you are authorized to use this payment method. Once your order has passed review by our Credit Department, it is sent to manufacturing and/or our warehouse for shipment. Credit card processing can take up to 3 business days (Depending on the accuracy of the information given to us by the customer.). Further, for security reasons, voice confirmation may be required before we can process your credit card for payment.

TOTAL TIME FOR DELIVERY Total time is based on the amount of time it takes to get payment authorization, order processing, whether the product is in our inventory at the time of order, and the transit time of the shipper. This can range from 24 hours to 10 days for in-stock items. Saturday and Sunday deliveries are not available.

If the item(s) on your order are in-stock, we will ship them as soon as possible from our warehouse or from one of our Distribution Warehouses located throughout the United States. If the item(s) on your order are out of stock, they will not be shipped until we have received and processed the back ordered inventory in our warehouse.

COMPUTER MANUFACTURE AND DELIVERY Our Home Automation Computers are custom built to Refined Automation and customer specifications. Software is loaded and configured to Refined Automation and customer specifications. To load software, we will open the customers purchased software package to load on their system. Once software has been opened, the customer will be charged for that software with no refund applicable. All open packages, disks, and items in those packages will be shipped to the customer when their computer ships. Refined Automation Computers will ship after the computers are assembled, software loaded, configured, and tested. To pass our quality assurance testing, computers will go through test scenarios, and be burned-in for a period of at least 24 hours to assure proper operation. Please allow 4-6 weeks for manufacture, customization, test, and delivery.

WARRANTY AND RETURN POLICY Every third party product you buy from Refined Automation is backed first by the product manufacturer's warranty. Refined Automation's 30 day limited warranty against defects, may also apply. Refined Automation's 30 day limited warranty is a defective exchange policy that provides for either repair or replacement (at our sole discretion) of merchandise that has been confirmed as defective by either the manufacturer or Refined Automation.

Due to licensing and copyright laws, we do not accept returns on software once a package has been opened. Defective software will be exchanged for the same title only according to Refined Automation's limited 30 day warranty described above. Hardware confirmed as defective by the product manufacturer or Refined Automation will either be exchanged or repaired at our sole discretion within the first 30 days of ownership only. After 30 days the product manufacturer warranty is the only warranty in effect. Terms and conditions may vary by product or manufacturer. Refined Automation will assist customers, whenever possible, in gaining satisfaction with product manufacturers.

For assistance, or to exchange a defective product, please email support@refinedautomation.com. Products returned for exchange must be in new condition, original packaging and include all disks, registration cards, packing materials and other accessories and be received within 30 days of the ship date. We reserve the right to refuse for return or charge a restocking fee for damaged or incomplete returns. No returns will be accepted without an RMA number issued by Refined Automation unless the product manufacturer's or distributor's return policies supersede ours.

WARRANTY LIMITATIONS There are no other express warranties or conditions on Refined Automation products. Implied warranties, if any, are limited to the duration of the express warranty provided herein. Some states do not allow limitations on how long an implied warranty lasts so that the foregoing limitation may not apply to you.

LIMITATION OF LIABILITY In no event shall Refined Automation, LLC, be liable for any indirect, direct, special, incidental, or consequential damages, including, but not limited to, personal injury, loss of use, loss of data, loss of business, or profits.

STATE SALES TAX Refined Automation, LLC is located in Burtonsville, MD, USA. We are required by the State of Maryland to collect sales tax from Maryland residents, or for purchases delivered in Maryland. Maryland sales tax does not apply for items shipped outside of Maryland to residents of other states. Maryland Sales Tax is not charged on shipping charges. We do not collect sales tax for other states. If you live in the state of Maryland, a 5% sales tax will be added to your total purchase price. (Effective January 3, 2008, Maryland State Sales Tax will increase to 6%.)

PAYMENT We accept Visa, MasterCard, Discover, and American Express only. Payment is due on the total amount of your order upon submission of your order to Refined Automation for processing. All payments are in US dollars. When you place your order on-line, please include a phone number and email for us to contact you for your credit card information, in case of error. This will speed up our processing and delivery of your order. All credit and debit card transactions conducted through our Web site are processed using 128-bit SSL encryption technology to ensure a completely safe and secure shopping environment for you. Your payment details will be securely encrypted and will not be accessed after your order has been processed. All orders placed over $2000.00 (USD ) must obtain pre-approval with an acceptable method of payment, as established by our credit and fraud avoidance department. We may require additional verifications or information before accepting any order.

SHIPPING POLICY Refined Automation offers free shipping on domestic US orders, within the continental 48 states. All orders will be shipped via a carrier of are choosing. We will accept an alternative form of shipping at the buyer's expense, and directive, if instructed at the time of purchase. A valid street address is required. We can not ship to post office boxes, APO's or FPO's. We attempt to minimize the number of packages shipped. Refined Automation may at it's discretion ship the entire order complete, or partial ship an order.

Shipping on International orders outside the US, and to Hawaii, and Alaska are paid by the buyer, regardless of order amount. Shipping charges will be quoted and charged to the buyer before the order amount is approved. Please leave us a phone number and email address on your order form so we may contact you with a final order amount. International orders will be shipped via UPS Next Day Air unless you specify otherwise. Upon receipt of payment, your order will be processed.

Additionally, customers outside the US should be aware that they will be responsible for the payment of any duty or excise fees your government charges on imported items. Please check with your local customs department so you know what to expect. If you elect to have shipping via UPS or Federal Express you will also be liable for a brokerage fee they place on international orders.

PRIVACY POLICY Refined Automation, LLC wishes to assure its customers that their private information will remain private. Refined Automation is dedicated to maintaining the highest standards of Privacy for its customers. Information collected from customers during the course of a business transaction will be protected, and will never be sold or in any way transmitted to any outside agencies. As due diligence, in the course of business, we do not store credit card numbers, or customer passwords. When these numbers are needed by Refined Automation, a specific request will be made to the customer for their credit card or password information.

APPLICABLE LAW By visiting Refined Automation.com, you agree that the laws of the state of Maryland, without regard to principles of conflict of laws, will govern these Terms and Conditions, and any dispute of any sort that might arise between you and Refined Automation.

DISPUTES Any dispute relating in any way to your visit to Refined Automation.com, or to products or services sold or distributed by Refined Automation, LLC in which the aggregate total claim for relief sought on behalf of one or more parties exceeds $10,000 shall be adjudicated in any state or federal court in Montgomery County, Maryland, and you consent to exclusive jurisdiction and venue in such courts.
